  This argument asks us to ignore the basic reality that USAID was established by congressional statute—specifically, the Foreign Assistance Act of 1961 signed into law by President Kennedy

  That's a complete lie. The act authorized funds, to be spent by the state department. The office of USAID itself was created by executive order and can ABSOLUTELY be dismantled by executive order. (later statues mention USAID, but do not create nor authorize it specifically). I'm not going through it line by line but your entire article is made up nonsense.

  It absolutely does.

  In this case, the existence of the agency was later enshrined in law by a statute approved by congress and signed by the president.

  Later laws mention USAID, they don't create it or authorize it.

  No, they're not. "employee" (he's actually a contractor) != "official". "Official" is laid out in the appointment's clause. Musk literally cannot be an "official" as per the constitution.
