    Jefferson said it long ago

Indeed I tremble for my country when I reflect that God is just: that his justice cannot sleep for ever: that considering numbers, nature and natural means only, a revolution of the wheel of fortune, an exchange of situation, is among possible events: that it may become probable by supernatural interference! — Thomas Jefferson, Notes on the State of Virginia

He will absolutely not get convicted. I don't see any route to either side getting two-thirds of the Senate seats, which is what the Dems would need to get a conviction, given the Cult of Donald that is the GOP. Whatever mechanism we want to employ to stop this fascist takeover, it sure as shit is not impeachment.

  • Justin Baldoni’s Defamation Suit Against Lively, Reynolds, NY Times Has Been Dismissed

There's more nuance to it than that, but you essentially have it right. Statements made within a lawsuit can have qualified privelage, as those statements are themselves the subject of the civil suit. Were those statements found to be defamatory, meaning lies told with knowledge of their falsity, there are mechanisms for punishment for that, but they otherwise are assumed to be made in good faith as part of the suit itself. Otherwise, every single civil suit could be countersued for defamation and you would see that all over the place. https://www.bdblaw.com/privilege-defense-in-a-defamation-case/

  • Sen. Joni Ernst To Constituents Regarding Medicaid Cuts: We’re All Going To Die, Someday

    Dark Helmet ( profile ), 04 Jun, 2025 @ 09:13am

Very cute, but inaccurate, as per usual. IL just passed its 2026 budget. It is balanced. GOP in IL are reduced to not liking how the accounting is done in the numbers when it comes to specific programs, but even they aren't trying to say it's not a balanced budget: https://abc7chicago.com/post/illinois-senate-passes-state-55b-budget-new-taxes-sports-bets-nicotine-products-income-sales-not-affected/16619774/ And the state is most certainly not seeing any kind of material decline in population. It goes up, it goes down, it goes up, it goes down in the past five years. The longer term trend is one of population growth, not decline. https://www.macrotrends.net/global-metrics/states/illinois/population

I can see your point here and it reminds me of my favorite bible story, the Good Samaritan, where the Samaritan sees the suffering person dying after being robbed on the side of the road, heads over to provide help, but then remembers that nobody has paid for him to ease the suffering of others and spits on the poor person instead, before kicking him in the ribs for good measure. Also, your entire post is essentially an advertisement for raising taxes, particularly on the wealthy.

  • US Measles Cases On Pace To Eclipse 2019, 1994 Case Numbers

    Dark Helmet ( profile ), 30 Apr, 2025 @ 09:22am

"The risk to the general populace (who all have measles shots) is fairly low." This is a misunderstanding of the state of things currently. The general populace is NOT all MMR protected. Current vax rates for MMR among the public is at roughly 93%, less than the 95% required for herd immunity protection. In addition, that vax rate has been falling for several years and is continuing to do so. This puts many more people at risk, while also allowing the disease to infect more hosts and, potentially, to evolve beyond current protections. IOW, this is a problem for all of us, not just the unvaxxed.

And what if they decide to deceive, or are perceived to have deceived, audiences in a way that doesn't specifically involve so-called "doctoring" or an interview. That's the problem with actions like this. They aren't as closed-ended as you seem to think they are. For example, should Newsmax even have a license anymore after this? https://www.reuters.com/business/media-telecom/newsmax-agreed-pay-40-million-settle-defamation-suit-over-2020-false-election-2025-03-13/

    Careful....

You folks really, REALLY don't want to go down this road. The GOP won't be in power forever and eventually this sort of censorship program will be turned around on the likes of Fox, NewsMax, etc. I don't want that to happen. And neither should you.

    Dark Helmet ( profile ), 07 Mar, 2025 @ 02:21pm

One would hope it's not a plan

Trump is pushing the constraining boundries out further than they've ever been. He's amassing more and more power to the Executive Branch. One would hope that the relative silence on all of this from Democrats is not a product of one simple truth: assuming we remain a democracy, the GOP will not be in power forever. I very much hope that the Dems aren't greedily biding their time....

  • Xbox Boss Surrenders In The Great Console Wars

    Dark Helmet ( profile ), 21 Feb, 2025 @ 10:51am

"then I have no idea what the word niche means." Outstanding, allow me to help. While the word has multiple definitions, this is the manner in which I used it: "a specialized segment of the market for a particular kind of product or service. "he believes he has found a niche in the market"" Nintendo has carved out a customer base for itself, quite successfully in fact, that is a non-majority percentage and one which also seeks something different from what Sony and Microsoft were producing with their consoles. This manifests in many, many ways, but here are what I think are the two best examples:

    1. Prioritizing Nintendo's great first-party franchises over 3rd party AAA games
    2. Prioritizing slick, often inventive experiences with the hardware rather than power and graphical visuals
Both of those are so self-evidently the reality of Nintendo consoles vs. the others that if you disagree with THAT, then this conversation is over because you're not dealing in reality. Put another way, Nintendo was never at war with Sony or Microsoft. They were busy gobbling up different customers/territory than the other two. Hence, they're a regional, niche player outside of the console wars (this was the entire point of the literally two sentences in which I mentioned them in the post). By contrast, Nintendo ABSOLUTELY was in a console war with Sega in the 16 bit days and for a while after that. And it WON that war with the final, culminating battle being the relative flop that was the DreamCast compared with the GameCube, released a few years later, which outsold the Sega by more than a factor of two. Are we now clear, or are you going to find a different, admittedly creative, reason to be upset?
